The MINUTES of the GENERAL MEETING held in the Board Room, Town Hall, Derby Road, Peel on Thursday 8th June 2006 at 7.00 p.m.

CHAIRMAN’S              06/039                The Chairman welcomed Mrs. Birkett to the

WELCOME                                              meeting following a period of illness.  He indicated that during the month he had attended Onchan Civic Sunday and also wished to express his thanks to the Town Hall staff for their sterling efforts on Honda Day which had taken place on 4th June and had proved to be a success with a large number of visitors coming to Peel. 

 

MINUTES                      06/040                The Minutes of the meeting held on 3rd May 2006 were taken as read and CONFIRMED.

 

CCTV                             06/041                The Town Clerk advised that tenders were to be submitted for the CCTV cameras and web cams by 12 noon on Monday 12th June 2006. NOTED

 

STREET                         06/042                The Town Clerk read out a letter from Mr. Alan

LIGHTING                                                Bridson of the Manx Electricity Authority regarding street lighting and the suggestion that maintenance testing of the street lights takes place in the evening to save on costs of the lighting being on during the day.  Mr. Bridson had indicated that there would be significant additional costs to carry out testing of street lighting during the evening not least the need to set out a more stringent working area on safety grounds due to darkness.  It was noted that residents of Peel did contact the Manx Electricity Authority with regard to defective lights.  Mr. Lightfoot suggested that a meeting with Mr. Bridson would be of benefit and it was AGREED that a meeting be set up accordingly. 

 

PEEL KART                   06/043                Reference was made back to Minute 06/016 and

RACING                                                   it was noted that contact was awaited from Mr. Hammonds the kart racing organiser, with regard to the viability of this year’s races. 

 

KERBSIDE                    06/044                Members noted receipt of a letter from the

COLLECTION                                         Department of Local Government and the Environment dated 22nd May 2006 concerning the makeup of the kerbside collection working party.  Members were somewhat disappointed to note that there were no representatives from the West on the working party. 

 

PEEL BEACH                06/045                Members considered a response from Captain Brew concerning the possible movement of sand on Peel beach.  Captain Brew had suggested that the Commissioners give consideration to the possible moving of sand by mechanical means as a result of tidal effects on the shore.  Captain Brew enquired as to whether there would be benefit in undertaking an environmental study in the first instance to identify the likely cause of any build-up of sand.  It was AGREED that this matter warranted further consideration in due course. 

 

PROPOSED                   06/046                Members noted receipt of a letter from Mr.

BUS SHELTER                                         Maule the Bus Services Delivery Manager at Isle of Man Transport in which he indicated that the proposed location for a new shelter on Tynwald Road would require a cantilever style shelter due to the limited space available on the footpath.  Isle of Man Transport did not have any such shelters currently in stock or available and Mr. Maule also suggested that it was his experience that the location was used more for persons alighting the bus rather than boarding.  The Isle of Man Transport did not consider this location to be an urgent priority but would advise when it was in a position to make proposals for installation.  NOTED

 

PEEL SEA                      06/047                Members noted receipt of the issue of a licence

OUTFALL                                                 to discharge waste off Peel beach under the provisions of the Water Pollution Act 1999 which had recently come into force.  The purpose of the Discharge Consent Licence was to legitimise the current position under the 1999 Act.  NOTED

 

TRAFFIC MIRROR       06/048                Members considered a letter from Mr. H Byrne

DOUGLAS ROAD                                    who had requested that the traffic mirror opposite the Rheast Lane entrance on the Douglas Road be re-positioned to a higher location to prevent footpath users moving the angle of the mirror.  It was AGREED that the matter to considered by the Traffic Management Liaison Group at its next meeting.

 

PUBLIC HEALTH         06/049                Members noted receipt of a letter issued on

ACT 1990                                                 behalf of the Commissioners by the Environmental Health Division in respect of 11 Church Street, Peel.  It appeared that the adjoining property 13 Church Street, Peel had penetrating dampness evident to the wall and ceiling to the top floor of the premises.  Following an inspection it appeared that the dampness could be caused by the chimney stack serving 11 Church Street.  The occupier had been given 90 days within receipt of this letter to abate the alleged nuisance.  NOTED

 

HOUSING (FLATS)      06/050                Upon recommendation from the Environmental

REGULATIONS 1982                              Health Officer it was AGREED that flats 1 and 2 Kimberley House, 8 Marine Parade, Peel be registered under the 1982 Regulations. 

 

                                                                  Mr. Mansell, Environmental Health Officer had also written a letter to the landlord of Orry Buildings, Michael Street, Peel in which the premises were currently registered under the 1982 Regulations.  It was alleged, following an inspection by Mr. Mansell, that a quantity of waste material including a fridge, freezer, gas bottles and fire, dismantled furniture and other materials had been left in the rear yard of the premises.  Mr. Mansell had insisted that the materials be removed and disposed of properly to leave the yard in a clean, safe and wholesome condition within a period of twenty eight days.  NOTED

PA 05/01277/A              06/053               The Town Clerk advised that an Appeal had been

ON APPEAL                                           submitted against the decision of the Planning Committee to grant approval in principle to Peel Town Commissioners for a forty bedroom hotel/leisure complex with up to fourteen two bedroom residential apartments on the former swimming pool site, Marine Parade, Peel.  NOTED

 

PA 05/00665/R               06/054               Members noted receipt of an Appeal hearing

ON APPEAL                                           decision in respect of the erection of four private lockup storage units, Heathfield Yard, Patrick Street, Peel for Mrs. B Corcoran.  It was noted that the Minster concurred with the Inspectors conclusions accepted the recommendation that the Appeal should be allowed and directed that the decision of the Planning Committee be reversed and that approval subject to conditions as stated be granted.  NOTED

 

VIKING                         06/055               Consideration was given to a request from the

LONGBOAT RACES                              MSPCA to hold a street collection on 1st July 2006 on the occasion of the Viking Longboat Races.  APPROVED

 

LOCAL                          06/056               The Town Clerk read out a letter from the Chief

GOVERNMENT BILL 2005                   Executive of the Department of Local Government and the Environment dated 2nd June 2006 in which an amendment to the Local Government Bill had been promoted by the Department following a deficiency in part four of the Town and Country Planning Act 1999 which came into operation on the 1st November 2005.  The deficiency related to the extent of what was termed “development” breaches of conditions such as those that control occupancy, hours of operation or noise levels were not currently offences under the Act and therefore not subject to prosecution.  The proposed amendment to the Local Government Bill 2005 would address these particular issues.  NOTED

 

 

 

APPLEDENE                 06/057               Consideration was given to a letter from the

FUNDRAISING                                      Social Services which wished to raise funds on the occasion of the Viking Longboat Races to provide a conservatory at Appledene, Radcliffe Villas, Glencrutchery Road, Douglas, a property used by the Government (for people with leaning disabilities).  The cost of the conservatory was approximately £30,000 and the staff of Appledene intended to raise funds by doing sponsored walks, organising racing nights and quizzes etc.  Comment was made over why a Government Division was seeking charitable funding rather than being provided out of Government finances.  At this stage it was AGREED to seek clarification as to why a Government Division was seeking charitable funding.

 

 

STREET LIGHT             06/058               Consideration was given to a letter from Mr. Ian

STANLEY MOUNT                                Jones who had recently constructed two houses in Stanley Mount, Peel.  It was indicated that one of the light was situated immediately outside the front door of one of the houses constructed and Mr. Jones had asked whether it could be moved to a new location.  At this stage it was AGREED to investigate the request and carry out an inspection. 

 

TOWN CRIER               06/059               The Town Clerk referred to an e-mail received from Mr. Griffiths from Skipton, North Yorkshire.  Mr. Griffiths was a member of the Ancient and Honourable Guild of Town Criers and was the official Crier for Skipton but was also looking for an additional honorary role in another town and had enquired whether Peel would be prepared to have a Town Crier.  The matter was discussed and it was noted that there already was a person with the title of Town Crier for Peel and it was AGREED to advise Mr. Griffiths accordingly.

 

OIL TANK                     06/060               Mrs. Birkett referred to the recently installed oil

HARBOUR TONGUE                             tank on the tongue of the harbour, East Quay constructed by the Department of Transport, Harbour Division.  Mrs. Birkett was of the opinion that the tank as sited presently could be construed as an eyesore and wondered whether anything more aesthetically pleasing could be done to improve the appearance of the tank – perhaps cladding.  It was AGREED to make suitable enquires of the Harbour Division.  Arising therefrom it was AGREED to enquire of Captain Brew whether a formal opening ceremony of the new harbour footbridge was envisaged. 

 

PROPOSED                   06/061               Mr. Gimbert referred to the Commissioners

REDUCTION OF                                    submission to the Department of Local

CONSERVATION AREA                       Government and the Environment, Conservation Officer for a reduction in the Conservation Area in Peel.  The matter had been deferred consequent upon the Conservation Office undertaking work on the Island plan.  It now appeared that this had been also deferred and it was AGREED to write a further letter to the Conservation Officer requesting that the matter be looked at and considered by the Department.
